1. Acceptance of Terms

By downloading, accessing, or using the myPurposedHeart mobile application (“App”) or any related services provided by Purposed Heart, a Florida-based entity (“Company”), you agree to these Terms of Service (“Terms”).

These Terms apply to all programs offered through the App, including but not limited to:

  • Group coaching

  • 1:1 coaching

  • Webinars & workshops

  • Exercise programs

  • Fasting programs

  • Juice cleanses

  • Detox or sugar detox challenges

  • Membership subscriptions

  • Digital materials, PDFs, videos, and resources

You must be 18 years or older to use the App.

2. Disclaimer — Not Medical Advice

Purposed Heart provides coaching and educational services only.

We do not:

  • Diagnose medical conditions

  • Treat psychiatric conditions

  • Provide medical nutrition therapy

  • Provide clinical counseling or psychotherapy

  • Replace medical care

All content is educational. You must consult a physician before beginning fasting, detox, diet changes, exercise plans, or supplementation.

You agree not to discontinue medication or treatment based on information from the App.

3. Informed Consent for Fasting, Detox, and Exercise Programs

By participating in fasting, detox, exercise, or nutrition programs, you acknowledge that:

  • These activities involve inherent health risks

  • You are voluntarily participating

  • You are responsible for your own medical clearance

  • You must stop participation and seek medical attention if adverse symptoms occur.

  • You assume full responsibility for your participation.

4. Coaching Services

4.1 Group Coaching

Group coaching is educational and not individualized medical or mental health treatment.

4.2 1:1 Coaching

1:1 coaching provides customized support but is not therapy or medical care.

4.3 Webinars & Live Events

Sessions may be recorded. By participating, you consent to being included in recordings.

5. User Responsibilities

You agree to:

  • Provide accurate information

  • Use the App lawfully

  • Refrain from sharing login details

  • Not misuse or redistribute any program materials

  • Treat community members respectfully

6. Community Conduct

You must not:

  • Harass, bully, or threaten others

  • Post offensive, obscene, or inappropriate content

  • Sell or promote unrelated products

  • Share private or confidential information of others

Violation may result in immediate account termination.

7. User-Generated Content

You retain ownership of content you submit but grant Purposed Heart a limited license to:

  • Display it in the App

  • Use it to provide services

  • Remove or moderate it at our discretion

You may not upload illegal, harmful, or copyrighted content you don’t own.

8. Payments, Subscriptions & Refund Policy

8.1 Payments

All payments are processed via third-party providers such as Swarm, Apple, Google Play, Stripe, or PayPal.

8.2 Automatic Renewals

Memberships renew automatically until canceled.

8.3 Cancellation

You may cancel at any time via your device’s app store or account settings.

8.4 Refunds

All sales are non-refundable, except where required by law.

9. Technology Limitations

We do not guarantee:

  • Continuous access

  • Error-free functionality

  • Data retention

  • Compatibility with all devices

We are not liable for technical issues or interruptions.

10. Third-Party Links & Affiliate Disclaimer

The App may include links to external websites or products.

Purposed Heart is not responsible for:

  • External content

  • Product safety

  • External privacy policies

  • Purchases made through third-party links

11. HIPAA Non-Applicability

Purposed Heart is not a healthcare provider and is not subject to HIPAA.

We still safeguard your information but it is not stored in a HIPAA-regulated environment.

12. Limitation of Liability

To the fullest extent allowed by law, Purposed Heart is not liable for:

  • Injuries or health complications from participation

  • Decisions made based on program content

  • Lost profits or data

  • App outages or technical issues

  • Your exclusive remedy is to discontinue use of the App.

13. Indemnification

You agree to indemnify and hold harmless Purposed Heart, its affiliates, contractors, and employees from all claims arising from your use of the Services.

14. Arbitration & Governing Law

Disputes will be resolved via binding arbitration in Florida, USA, under AAA rules.

This Agreement is governed by Florida law.

15. Electronic Communications Consent

By using the App, you consent to receive:

  • Emails

  • Push notifications

  • In-app messages

You may opt out in your settings.

16. Modifications

We may update these Terms at any time. Continued use constitutes acceptance.
